Birmingham considers temporary pause on data centers to review regulations

The city of Birmingham is exploring a temporary pause on new data center construction while officials develop updated regulations for the rapidly expanding industry. The discussion follows public concern over a recently approved $14 billion, 18-building hyperscale data center campus in Bessemer.

Public Hearing Highlights

On January 13, more than a dozen speakers addressed the Birmingham City Council during a public hearing on data centers. Many supported a proposed six-month moratorium to allow the city time to examine zoning laws, environmental impacts, water and power usage, and placement rules for new facilities.

 

Officials noted that Birmingham currently has no new data center applications pending. However, residents in Oxmoor Valley reported being approached by a company seeking to build a facility less than 500 feet from homes. Environmental concerns, including potential effects on watersheds and utility rates, were raised by speakers.

Need for Updated Zoning

City leaders emphasized that existing zoning laws are not designed for modern hyperscale data centers, which can consume hundreds of megawatts—far more than older, smaller facilities like DC BLOX. Council members highlighted the need to categorize data centers for zoning purposes and ensure “smart growth” that balances economic development with community and environmental protections.

Next Steps

The proposed moratorium has been referred to the Planning and Zoning Committee for further study. The committee is expected to return recommendations to the full City Council in February. City officials stressed that the pause would not prevent data centers entirely but would provide time to develop clear, effective regulations.

 

Residents and business leaders alike expressed the importance of careful planning to ensure that future data center development aligns with Birmingham’s community and environmental priorities.
