A Jefferson County judge ordered Central Alabama Water to restore fluoride to its water system after the City of Birmingham filed a lawsuit over the utility’s decision to halt fluoridation. The ruling requires the utility to comply until a court hearing scheduled in early April.
Court Finds Likely Violation of State Law
Judge Fred Bolling issued the temporary restraining order after reviewing claims that Central Alabama Water stopped fluoridation without providing the 90-day notice required under Alabama law. The judge wrote that the lack of notice likely violated state requirements and could harm customers. The order states that the city has a strong chance of succeeding in its case.
The lawsuit argues that the utility acted too quickly when it ended fluoridation for its approximately 750,000 customers. The court emphasized that state law requires advance notice before any changes to fluoridation practices begin or end.
Public Health Concerns and City Response
City officials, including Mayor Randall Woodfin, criticized the decision to stop fluoridation. They pointed to fluoride’s role in preventing tooth decay, especially in children. They also argued that the utility failed to follow proper procedures before making a decision that affects public health.
Central Alabama Water responded by citing equipment issues and high repair costs, estimated at $3.7 million. The utility also noted that several of its treatment plants had already stopped fluoridation in previous years due to broken equipment.
Ongoing Legal Dispute and Next Steps
The judge’s order remains in place until a hearing scheduled for April 2. At that time, the court will consider whether to extend the injunction or issue a longer-term ruling.
Central Alabama Water has also asked the judge to recuse himself from the case, raising concerns about prior professional ties and comments made in the ruling. The court has not yet decided on that request.
The case continues to draw attention as it raises questions about public health policy, regulatory compliance, and utility management in the Birmingham area.
